2. Account Registration

• Eligibility: You must be at least 18 years old to create an account on Ofreelancer.com. By registering, you represent and warrant that you have the legal capacity to enter into these terms.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. Ofreelancer.com is not liable for any loss or damage arising from unauthorized access to your account.

3. Platform Use

• Freelancer Responsibilities: Freelancers must provide accurate information in their profiles and promptly complete tasks as agreed upon with the super-admin. Misrepresentation of skills, experience, or capabilities is prohibited.
• Superadmin (Client) Role: The superadmin is responsible for posting jobs, selecting freelancers, and managing payments. All job posts must be clear, legal, and in accordance with Ofreelancer.com’s guidelines.
• Prohibited Activities: Users are prohibited from engaging in activities that violate any law, infringe on the rights of others, or interfere with the operation of the platform. This includes, but is not limited to, fraud, spamming, harassment, and the distribution of malware.

4. Payments and Fees

• Freelancer Earnings: Freelancers will be paid according to the terms agreed upon in the job contract. Ofreelancer.com will deduct a commission from the freelancer’s earnings as agreed during account setup.
• Superadmin Fees: The superadmin may be required to pay fees for job postings or other services offered on Ofreelancer.com. All fees are non-refundable unless otherwise stated.
• Taxes: Users are responsible for complying with all applicable tax laws. Ofreelancer.com is not responsible for calculating, reporting, or withholding taxes on behalf of users.

5. Intellectual Property

• User Content: By uploading content to Ofreelancer.com, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and promoting the platform.
• Platform Ownership: Ofreelancer.com retains all rights, title, and interest in and to the website, including its content, features, and services. Unauthorized use of our intellectual property is prohibited.

6. Dispute Resolution

• Disputes Between Users: Any disputes between users (e.g., between freelancers and the super-admin) should be resolved directly between the parties involved. Ofreelancer.com may offer mediation services at its discretion but is not obligated to do so.
• Governing Law: These terms shall be governed by and construed in accordance with the laws of [India], without regard to its conflict of law principles.

7. Termination of Service

• Termination by Users: You may terminate your account at any time by contacting us or through your account settings.
• Termination by Ofreelancer.com: We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to violations of these Terms and Conditions.

8. Limitation of Liability

• No Warranty: Ofreelancer.com is provided on an "as is" and "as available" basis. We do not guarantee that the platform will be error-free, secure, or uninterrupted.
• Liability: To the fullest extent permitted by law, Ofreelancer.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the platform; (ii) any unauthorized access to or use of our servers; (iii) any bugs, viruses, or other harmful code that may be transmitted to or through our platform.

9. Changes to Terms

Ofreelancer.com reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the platform after any such changes constitutes your acceptance of the new Terms and Conditions.
